Terms of Service

If you use GradiBee on behalf of a minor learner, or you are a parent or guardian linking or consenting for a learner, you accept these Terms for yourself and, to the extent permitted by law, on behalf of that learner. You represent that you have authority to do so.

Our Privacy Policy explains how we handle personal data and forms part of your relationship with us. In case of conflict about privacy practices, the Privacy Policy controls for data-protection descriptions; these Terms control for use of the Service, payments, and liability.

The Service is operated by SOPWIL. These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law rules that would apply another jurisdiction’s laws.

Subject to any mandatory rights you have under Sri Lankan law, the courts of Sri Lanka have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

GradiBee is intended for learners in Grades 5–11 (curriculum-aligned tutoring, including Grade 5 Scholarship papers) and for parents or guardians who manage family accounts and payments. Administrators may be designated by SOPWIL.

Learners may note an optional grade on their profile for information only; it does not limit which tutors they can open. After the signup trial, paid access requires a parent checkout. Misrepresenting role or parental authority is a material breach.

Parents and guardians are responsible for supervising minors’ use of the Service and for payment for family packs where applicable.

You must provide a valid email and a password meeting our requirements, and keep your credentials confidential. You are responsible for activity under your account, except where caused solely by our proven failure to secure the Service.

We may refuse registration, require verification, suspend, block, or terminate accounts for suspected fraud, abuse, chargebacks, security risk, breach of these Terms, or as required by law. Contact privacy@gradibee.app if you believe a block is in error.

Parent access codes and consent links are sensitive. Do not post them publicly. Anyone who obtains a code may attempt to link or consent for a learner.

Parents may link learners using a parent access code, view progress and Pulse-style summaries for linked learners, and purchase packs. Observe mode, where available, is read-only and time-limited; it does not authorise the parent to act as the learner for chat, papers, or Trail mutations.

Guardian consent without a full parent account adds the learner to a family when a parent signs in later; it does not by itself create a paid subscription. Paid packs require a parent (or authorised) checkout.

We do not compare siblings for ranking. You agree not to use family features to harass or unfairly pressure learners.

Learning time and features may be sold as packs or subscriptions (for example hours and token allowances per tutor) as shown in the Service at checkout. Prices are typically in Sri Lankan Rupees (LKR) unless otherwise stated.

Payments are processed by PayHere. You agree to PayHere’s terms when you pay. We receive payment confirmation and related order metadata; we do not store full card numbers on GradiBee servers.

Unless mandatory Sri Lankan law requires otherwise, fees are non-refundable once paid, and any refund or credit is at SOPWIL’s sole discretion. Chargebacks, payment disputes used abusively, or fraud may result in suspension and recovery of costs to the extent permitted by law.

Unused allowances expire or pause according to the pack rules shown in the product. We may change prices or pack structures prospectively; changes do not alter fees already successfully charged unless required by law.

You may use GradiBee only for lawful personal learning and family management. You must not: attempt to bypass curriculum locks or safety filters; scrape, bulk-download, or republish our content or corpus; reverse engineer the Service except to the limited extent mandatory law allows; share accounts or credentials; interfere with or overload the Service; upload malware or illegal content; harass others; or use the Service to violate school or exam rules (including using AI output as unauthorised exam cheating).

We may monitor for abuse, rate-limit, and remove content or access as reasonably necessary to protect the Service and users.

GradiBee provides AI-assisted tutoring intended to stay within subscribed subject and grade. Answers may be incomplete, outdated, or incorrect. The Service helps you learn; it does not guarantee exam results, grades, school admission, or any particular educational outcome.

GradiBee is not a substitute for school, teachers, or professional advice. You (and parents for minors) are responsible for verifying important information and for how learners use AI output.

SOPWIL is not affiliated with or endorsed by the Sri Lanka Ministry of Education merely because content is curriculum-aligned. Alignment to syllabus topics does not mean official MoE approval of GradiBee.

GradiBee branding, software, original lessons, Trail features, and related materials are owned by SOPWIL or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal educational use as permitted by your account and packs.

You may not copy, modify, distribute, sell, or create derivative works from our content or corpus except as expressly allowed in writing or by mandatory law. Third-party marks (including PayHere and Google) belong to their owners.

You retain rights in content you submit (such as chat messages, Echo text, and avatars), subject to these Terms. You grant SOPWIL a worldwide, non-exclusive licence to host, process, transmit, and display that content as needed to operate, secure, and improve the Service, including sending content to Google Gemini as described in the Privacy Policy.

We are not obliged to store chat transcripts. You represent that you have the rights to submit the content and that it does not violate law or others’ rights.

The Service depends on third parties (hosting, database, PayHere, Google Gemini, fonts or infrastructure). Outages, errors, or policy changes by those parties are outside SOPWIL’s reasonable control. Your use of their services may be subject to their terms.

You may stop using GradiBee at any time. Parents may erase their account and linked learner accounts from Profile. Learners may request erasure in-app; a linked parent reviews the request and GradiBee completes it. Completed erasure cannot be reversed. You may also email privacy@gradibee.app as described in the Privacy Policy.

We may suspend or terminate access immediately for breach, non-payment, legal risk, security incidents, or prolonged inactivity. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) survive termination.

To the maximum extent permitted by Sri Lankan law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, or non-infringement.

Nothing in these Terms excludes liability that cannot be excluded under applicable mandatory law.

To the maximum extent permitted by Sri Lankan law, SOPWIL and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, goodwill, or educational opportunity, arising from the Service or these Terms, whether based on contract, tort, or otherwise, even if advised of the possibility.

To the maximum extent permitted by law, SOPWIL’s total aggregate liability for all claims relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid to SOPWIL for GradiBee packs in the twelve (12) months before the claim, or (b) LKR 5,000.

These limits are a fundamental part of the bargain and apply even if any remedy fails of its essential purpose, except where mandatory law provides otherwise.

You agree to indemnify, defend, and hold harmless SOPWIL and its officers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your (or a linked learner’s) misuse of the Service; content you submit; breach of these Terms; or violation of law or third-party rights—except to the extent caused by SOPWIL’s wilful misconduct.

We may modify features, tutors, pricing, availability, and these Terms. We will update the “Last updated” date on this page. Where practical, we may provide additional notice for material changes.

If you continue using the Service after Terms change, you accept the updated Terms, except where mandatory law requires express consent. If you do not agree, stop using the Service and request account closure.

SOPWIL is not liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, labour disputes, internet or power failures, epidemics, governmental actions, or failures of third-party providers (hosting, payments, or Google Gemini).

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy are the entire agreement between you and SOPWIL regarding the Service and supersede prior understandings on that subject.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation, merger, or sale of assets. Headings are for convenience only.

Nothing in these Terms creates a partnership, employment, or agency relationship between you and SOPWIL.
